This website HexaHome.in (hereinafter referred to as"HexaHome"), is owned, hosted, and run by Hexadecimal Software Private Limited (hereinafter referred to as "HSPL" ), a company incorporated in India under the Companies Act, 1956 and having its registered office at Corporate Park, Sector 142, Noida Uttar Pradesh, India. It also includes any subdomains and other platforms through which its services are accessible, such as our applications for smartphones, tablets, and other smart devices, and application program interfaces, etc. (collectively referred to as "HexaHome"). A legally binding agreement between HexaHome and the User (the "Agreement") governs the use of these services and is comprised of these terms and conditions, privacy policy, and community rules.
You may access online information and communication services from HexaHome and/or other platform(s) connected to this application, provided that you abide by the terms and conditions outlined below.
All rights reserved, HSPL may amend or modify these terms and conditions at any time. Modifications will take effect immediately after they are posted on HexaHome. It is recommended that users periodically examine the amended terms and conditions to be updated on any modifications. Your continued use of HexaHome and/or access will be interpreted as your final agreement to these terms and conditions, as updated from time to time. HexaHome's operation may also be halted by HSPL for any number of reasons, including maintenance, content updates, technical support, or other needs.
In the event that your usage of HexaHome deviates from these terms and conditions, HSPL has the right to restrict your access moving forward, cancel your account, and/or pursue further legal action.
Definition
- Any individual or legal entity subscribing to HexaHome's services, whether free or paid, is termed a "Subscriber". Access to HexaHome requires signing in via Google, Apple, or phone number with OTP verification. Certain services within HexaHome are publicly accessible, while others, such as viewing specific numbers, are restricted to approved users only.
- A "Browser/Visitor" is an individual who uses any of HexaHome's services (i.e., visits non-restricted areas of HexaHome) without having to register for an account.
- The following terms & conditions and community rules govern how HexaHome is used and accessed. Any individual who accesses the services without having the necessary authorization, either legally or contractually, will be considered an "unauthorized user" for the purposes of this Agreement. These people are still bound by the terms and conditions that govern how HexaHome is used, especially the ones that deal with respecting HSPL's intellectual property rights and adhering to the terms and conditions below. Both the Browser/Visitor and the Subscriber/Advertiser(s) are included in the words "User" and "Customer”.
- The interactive online information service that HexaHome offers over the internet is referred to as "Service" or "Services." Users can use search tools that meet their criteria and access data recorded in HexaHome's database. Services also feature areas where clients can place banners and listings for advertising purposes. HexaHome serves only as a conduit for the transmission of information; it does not, either explicitly or implicitly, act as an agent on behalf of any User or Customer.
The Real Estate (Regulation and Development) Act, 2016, as amended, and any rules or regulations formulated under it are referred to as "RERDA".
Listing/Advertisement Submission and Management
- Users of HexaHome consent to refrain from submitting any financial, contact, or other information, along with property descriptions, to HexaHome unless they have obtained all required permissions and rights from the property owner or the holder of the power of attorney, including permission from the photographer and/or copyright owner of any photographs.
- This includes the freedom to list and promote the aforementioned property(s) on HexaHome or the User's website.
- HexaHome does not assert any ownership, either directly or indirectly, over any person in relation to banners that its clients host on its platform.
- These banners are only in the nature of HexaHome's space sales, and HexaHome has not independently confirmed the legitimacy of these photos, banners, or listings, nor their compliance with any applicable legal requirements.
- Some listings might include video footage from third parties ("Video Content") that is only offered for general informational purposes. This content is not intended to be a solicitation, recommendation, or attempt to sway any decision or purchase. HexaHome and the video content suppliers make no claims about the accuracy or comprehensiveness of the content.
- In accordance with the due process of law, Users covered by the Real Estate (Regulation and Development) Act, 2016 (RERDA) must receive all necessary approvals, licenses, and permits granted by relevant authorities for the Project/Land/Apartment/Plot in the listing. Users are required to abide by all laws that may be relevant to the Project, Land, Apartment, or Plot in the listing.
- In relation to their RERDA registrations, the User shall reveal the current condition and type of the property, including whether or not it is free from all encumbrances, as well as any significant information needed by law. The User might be asked to swear an affidavit attesting to the veracity of the information/data supplied/displayed, as well as produce specific documentation to bolster any assertions they make regarding the property's condition. At its discretion, HexaHome may look for and remove properties that are said to be in violation of these rules.
- Furthermore, the User consents to other users of the HexaHome website searching, accessing, and referring to the property listing, or any portion of it.
- HexaHome retains the exclusive right to determine the search, display, accessibility, download, copy, and other uses for any property on HexaHome. It also has the right to change any property listing that is subject to these terms and conditions.
- Along with the terms indicated above, the User also accepts:
(a) To guarantee and reflect the accuracy of all attributes and related data supplied
(b) Not to allow a property to be posted on HexaHome under a name other than that of a real estate agent who has been duly appointed and approved by the owner of the property.
- HexaHome maintains the right, in a manner consistent with normal commercial business standards, to remove all or any portion of the properties displayed on the HexaHome without prior notice.
- HexaHome disclaims any liability for the correctness of any reports or data files that users submit. HexaHome guarantees that data backup and business restart will occur, however backup copies of all data, images, and other materials provided or uploaded to HexaHome are the User's sole responsibility.
- When purchasing or renting a property through HexaHome, users are required to independently confirm all information related to the property, such as its ownership, title, right, and lien. The 'verified' tag that appears on HexaHome properties denotes the verification of the property's existence as stated; it does not imply a verification of the property's area, ownership, or pricing data.
Eligibility
You affirm to the Company that you are at least eighteen (18) years of age and capable of entering into a legally binding contract, and of complying with these Terms & Conditions. Users under the age of 18 may use the site's services only under the supervision and guidance of their parents or legal guardians, using the registered account of such parent/legal guardian. Before uploading any content, posting comments, or using any other services of this site, you agree to register and provide your details, including full name, email address, and contact number.
Subscription Plans
- HSPL provides a range of services that users can subscribe to based on their needs, subject to payment of the applicable fees.
- The subscription fee paid by the User is non-refundable, except in cases where the User has opted for the Moneyback Plan, as specified on the Site.
- HSPL reserves the right to revise the fees of any subscription plan at any time—whether before, during, or after the User's subscription period—without prior notice to the User.
- There are no warranties about server uptime or application functionality from HSPL. Liability is restricted to the amount originally paid.
- HSPL reserves the right to amend, alter, or change all or any disclaimers or terms of agreements at any time without prior notice.
Security of Payment Information:
- HSPL uses the utmost care to ensure that all data/information related to electronic money transfer remains secure.
- Online transactions involving payments direct the user to a Payment Gateway; HSPL does not store credit card data.
HSPL shall not be liable for any loss or damage sustained due to any disclosure of information concerning the user's account and/or information relating to online transactions.
Violation of Terms and Conditions
- If the Terms are violated, the Company reserves the right to take various legal actions, including promptly removing offending material from its site, canceling user accounts, and excluding individuals who breach any Terms & Conditions.
- The Company may also seek injunctive relief from a court with jurisdiction and pursue violators under relevant criminal and civil laws. Hexahome will assist in investigations by any competent Central, State, or local authority or court without prior notice to the user.
- If the Company determines that any advertisement or service could create liability, it may take necessary actions to minimize or eliminate such liability, including disclosing user information.
- Ultimately, the Company retains the right to refuse service to anyone, remove listings, or advertisements as deemed appropriate
- HexaHome reserves the right to withhold refunds in the case that inaccurate or offensive property content is displayed on the website.
Obligations and Representations of User
- The User agrees to provide accurate, complete, and correct registration data when applying for Services.
- All data entered on the Site will undergo mandatory verification by the Company. The User must obtain any necessary licenses, permits, consents, approvals, and intellectual property rights required for using the Service at their own expense.
- Compliance with all notices or instructions from the Company is mandatory for using the Service.
- The User acknowledges responsibility for all applicable taxes and costs incurred through use of the HexaHome’s services.
- The users are accountable for the accuracy, legality, and consequences of the data they handle or interact with, whether it involves retrieving information from the system, storing it on the platform, or transmitting (sharing) it to others.
- Keeping user identification confidential is the User's responsibility, as well as ensuring no unauthorized use of their account or breaches of security. Prompt notification to the Company of any unauthorized use or breaches is required.
- Payment of Subscription Fees must be made promptly when due.
- The User affirms they are above 18 years of age and capable of entering into contracts.
- They are responsible for setting up their equipment for accessing the Services.
- The User agrees to the 72-hour processing time for online advertisements placed with HexaHome.
- Any data entered may be saved, used, and commercially exploited by HSPL as deemed appropriate. The User grants HSPL a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable right to exercise all copyright and publicity rights over material or User Data in their listings. "User Data" includes all submitted information except sensitive personal data. The User warrants the accuracy and completeness of their User Data.
- The User indemnifies HSPL for any claims arising from information posted on the Site by them or on their behalf.
- The User is solely responsible for the data entered on the Site and will be liable for any consequences resulting from inaccuracies, although the Company will endeavor to remove false data promptly upon verification.
Use of Information:
- User consents to treat as HexaHome' property any and all information gleaned from the Service, including listings, member directories, and any other material made available to User via the Service (collectively, "Content").
- Users use any content at their own risk; HexaHome makes no guarantees regarding its accuracy and does not support or recommend any particular content.
- Users may see the listings and adverts on the Service only in order to gather preliminary data for later analysis and research.
- Listings accessed from the Service may not be used for further distribution, publication, public display, or the creation of derivative works, nor may the User permit any of these uses.
- The User may only access and use listings for personal and internal use.
- Any Content that is downloaded from the Service or otherwise made available to User in the Service may not be used or reproduced by User for or in conjunction with any other listing/advertising Service or device.
- The user also agrees not to use the company's service in any other way or in conjunction with any other listed service or device.
- Users who break any of these particular terms—in particular, those who use automated or manual methods to search the Service abusively or excessively—risk having their memberships immediately terminated without prior warning.
Intellectual Property Rights:
- Any trademarks, brands, trade names, and service marks (collectively, "Marks") that appear on HexaHome are either owned by HSPL and/or its affiliates, or they are used under license.
- All resulting rights, whether by statute or otherwise, belong exclusively to HSPL and its affiliates.
- The User is not granted any license or permission to use these Marks in any way by accessing HexaHome; as a result, using these Marks in any way is strictly forbidden.
- According to the current Indian legislation, any infringement of the aforementioned would be illegal.
- HSPL has complied with all applicable Indian regulations regarding intellectual property rights and will do so in the future.
- To the best of its ability, HSPL will uphold and safeguard users' and third parties' intellectual property rights.
- If it is discovered that a User or Users are using HexaHome as a platform to violate the intellectual property rights of other parties, HSPL shall have the right to immediately terminate this Agreement without providing the User with any notice.
- By permitting Users to use HexaHome, HSPL grants Users the right to access and use the Services, subject to the limitations, non-exclusive, non-assignable, and revocable license (the "License"), as long as Users comply with the Agreement's terms and conditions.
Restrictions/Prohibitions:
- Making use of HexaHome' services in any way that would harm the organization's objectives or ability to operate, as well as anything that would violate RERDA or other legal requirements.
- Reproducing, removing, downloading, sharing, altering, offering for sale, keeping, disseminating, creating derivative works from, or otherwise making use of any data, information, or profiles—including photos, graphics, and personal information—that are accessible on HexaHome and/or any services or products of the HSPL in any way or for any reason that isn't compliant with the terms of use.
- Accessing, navigating, searching, copying, monitoring, downloading, scraping, crawling, or otherwise extracting in any way any data or content, including but not limited to adding or downloading profiles, contact information, or sending or redirecting messages from HexaHome; (using or attempting to use any automated program, software, system, or any similar or equivalent process; this includes spiders, robots, crawlers, etc.)
- Attempting or succeeding in gaining unauthorized access (including through password "mining," hacking, or other methods) to any of the following:
- any feature or portion of HexaHome, or any services or goods provided on or through HexaHome, that are not meant for you;
- any server, website, program, or computer systems owned by the HSPL, any other third parties, or Users
- Using any technology to alter the services offered by HexaHome or their appearance; adding another service on top of them; or simulating HexaHome's services or operations in any way
- Using interfaces other than those that the HSPL has specifically allowed to access HexaHome
- Trying to circumvent or violate any security or authentication procedures that the HSPL has put in place in regard to HexaHome, as well as trying to probe, scan, or test the system or network's vulnerability
- Using any process, whether automatic or manual, to scrape, download, copy, duplicate, or otherwise extract information or data from HexaHome in order to offer any goods or services that are comparable to or could in any way rival those offered by the HSPL
- Reverse engineering, disassembling, decompiling, decoding, or attempting to do any of the aforementioned tasks, or extracting the source code for the application or website, any associated technology, or any portion of it
- Trying to go around any technological safeguards put in place by the HSPL or any other party in an effort to preserve the content on HexaHome and/or prevent robots, spiders, and other crawlers from accessing or scraping any content from the site.
- Ignoring, evading, or attempting to evade any service limitations, such as search limits, Captcha limits, and instances on various triggers
- Interfering with or attempting to interfere with, or disrupt, the use of HexaHome or any computer networks linked to HexaHome by any other User, including by using any device, software, or routine
- Creating, utilizing, or attempting to use any automated program, scripts, robots, third-party software or system, or any comparable or equivalent process (such as spiders, robots, crawlers, browser plug-ins/extensions/add-ons, iframes on third-party websites, mirroring, HTML parsers, etc.) to access, navigate, search, copy, monitor, download, scrape, crawl, or otherwise extract or modify in any way any data or content from HexaHome without express written consent obtained by contacting us at support@hexadecimalsoftware.com
- Posing as another individual or organization, or deceiving as being employed by or associated with any individual or organization
- Forging headers or otherwise tampering with identifiers to conceal the source of any user data pursuing, threatening, or intimidating another user in any way
- Placing an unjustified or too heavy burden on HexaHome' infrastructure
- Constructing deep connections into HexaHome (or any portion of them) and "framing," "mirroring," or otherwise mimicking the look or functionality of HexaHome (or any part of it) without HSPL's prior consent
- Sending unsolicited bulk or commercial emails, or uploading, posting, emailing, sending SMS, or otherwise making them available, directly or indirectly, is considered spamming HexaHome/HSPL or any other Users
- Storing, altering, uploading, sending, publishing, or disseminating any content or data that:
- Violates all currently in effect local, provincial, state, federal, or international laws, statutes, ordinances, rules, or regulations;
- Belongs to someone else and over which you have no authority;
- Violates, infringes upon, or in any other way transgresses the intellectual property rights of the HSPL or any third party, including rights of publicity, privacy, or copyright;
- Includes computer viruses or other malicious software, files, or programs intended to damage, corrupt, or impede the operation of HexaHome or any other computer system or resource;
- This includes content that is or may be interpreted as harmful, threatening, abusive, harassing based on gender, libelous, blasphemous, vulgar, pornographic, paedophilic, obscene, or racially or ethnically offensive;
- That encourages conduct that would constitute a criminal offense, give rise to other liability, or otherwise violate applicable law;
- That deceives or misleads the addressee about the origin of such messages or communications
- That injures minors in any way;
- Endangers India's unity, integrity, defense, security, or sovereignty; Impairs friendly relations with other countries; Disrupts public order; Incites the commission of any crime that is punishable by law; Prevents the investigation of any crime; or Is derogatory to any other country.
By using this agreement, you specifically consent to not duplicate and disseminate this material on any other server; alter or reuse any text, graphics, sound, or other content on HexaHome to any other system.
HexaHome prohibits the following:
- Removing any copyright, trade mark, or other intellectual property notices from any material copied or printed off from HexaHome or link to HexaHome without our express written consent
- No part of HexaHome may be modified, altered, or included in any other work, publication, or within HexaHome itself, whether in hard copy or electronic format, including postings to any other HSPL services or entities.
- System or network security violations may subject one to legal or criminal consequences.

Disclaimer and Warranties
- According to Section 2 Subclause (w) of the Information Technology Act of 2000, HexaHome is an intermediate.
- The information on HexaHome is given "as is" and "as available" basis, without any kind of implied or explicit warranties or representations.
- All warranties, express or implied, statutory or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement of third party rights, completeness or accuracy of the information, update or correctness of the information, freedom from computer viruses, and other violation of rights regarding services, products, material, and contents of HexaHome, are disclaimed by HSPL and any third party providing materials, services, or content to this website.
- The opinions shared by users are their own, and HSPL neither supports nor accepts liability for them. Although every effort is made to ensure that the content is not misleading, offensive, or inappropriate, no claims are made on the truth and veracity of the information on the website. If you come across any inaccurate or inappropriate content on the website, please report it to stop abuse.

Investment in any project that has not been officially sanctioned and launched by the Builder/Promoter is not encouraged by HSPL; users who deal with such projects do so at their own risk and responsibility.

Limitation of Liability:

- Any error, omission, interruption, deletion, defect, delay in operation or transmission, failure of a communication line, theft or destruction, or unauthorized access to or alteration of user data/information are all solely the responsibility of HSPL.
- HSPL disclaims all liability for any issue or technical malfunction relating to online systems, servers, providers, computer hardware, software, email malfunctions, or players' computers due to technical issues, traffic congestion on the Internet, at any website, or any combination of these. This includes harm or damage to Users, Members, or third parties' computers resulting from using the website or from participating in its activities.
- The term "customer" shall only refer to paying customers who have not subscribed to HexaHome for commercial gain (business reasons) and who intend to use the services only for their own use, as defined by the Consumer Protection Act, 2019 (CPA).
- The performance obligation of HSPL (service provider) is to grant the customer access to its online portal for the duration of the subscription period, unless otherwise specified. This obligation does not create any additional performance obligations on HSPL's part. With reference to any usage, by whatever name called, or any other performance obligation, if any, is to provide the upper limit for consumption.
- If any information on this website is inaccurate, HSPL disclaims any liability.
- HSPL does not guarantee the confidentiality of information provided to it by any person acquiring/using any of the information displayed on the HexaHome website or any of its other websites / domains owned and operated by HSPL.
- HSPL is not liable for any privacy breaches or breaches of the information provided by the consumer to HSPL to be placed on the website by technical or any other means.
Termination:
For any reason, including, without limitation, that HSPL believes you have broken or behaved inconsistently with the letter or spirit of these terms and conditions or any applicable law, HSPL may, in its sole discretion, terminate or restrict your use or access to HexaHome (or any part thereof) at any time and without prior notice.
Indemnification:
- Submissions and the unapproved use of any information or materials found on HexaHome may be illegal under copyright, trademark, privacy, and publicity laws, as well as under certain statutes and regulations pertaining to communications and other applicable laws, statutes, and rules and regulations. You are solely accountable for everything you do or anything someone else does with your login credentials.
- By using the HexaHome material, you agree to use reasonable legal and accounting fees to defend, indemnify, and hold harmless HSPL and/or its associates, subsidiaries, officers, directors, employees, affiliates, licensees, business partners, and agents against any claims, actions, or demands that arise from your use of the material or from your violation of these terms and conditions or any applicable law.
- Legal disputes arising from contracts made through these Services will not implicate HSPL. If in any case HSPL became a target of legal action, the party naming HSPL as a defendant must bear the expenses associated with such legal proceedings. HSPL is obligated to comply with any court orders served to it through appropriate legal channels
Refund Policy
- General Refund Terms: All subscription fees paid by the User to HSPL (Hexadecimal Software Pvt. Ltd.) are non-refundable unless the User has expressly subscribed to a Money Back Guarantee Plan, and the conditions outlined herein are satisfied.
- Money Back Guarantee Plan Refund Eligibility: Under the Money Back Guarantee Plan, the User is entitled to request a refund of the subscription fee paid to HSPL only if the core service deliverables remain unfulfilled. For property owners, this means a refund applies solely when HSPL fails to generate a verified lead—whether a tenant or a buyer—for the listed property within the active subscription period.
- Documentation Requirements: To process any refund claim, HSPL reserves the right to request supporting documentation, including but not limited to:
- A valid Rent Agreement or Sale Agreement
- PAN Card copy (for identity verification)
- Maintenance Bill (if applicable)
- Any additional proof reasonably required to verify the transaction or ownership
Failure to provide satisfactory documentation within the stipulated timeline may result in denial of the refund claim. - Exclusions from Refund Eligibility: No refund shall be entertained in the following scenarios:
- If the User withdraws the property listing during the subscription period.
- If the User engages in misleading, abusive, or fraudulent activity.
- If the User refuses to respond to interested tenants or buyers facilitated by HSPL.
- If the property is priced significantly above prevailing market rates without valid justification.
- If the User rejects verified leads without valid reasons or shows unwillingness to close deals.
- Refund Process and Timeline: Approved refunds shall be processed within 7 business days from the date of submission of all required documentation. Refunds will be credited to the original payment method, subject to applicable bank processing timelines.
- Processing Fees: All refunds, where applicable, shall be subject to a deduction of a nominal processing fee, as determined by HSPL at its sole discretion.
- Partial Refunds and Usage Charges: If HSPL has partially fulfilled the service (e.g., generated verified leads but no successful closure), only a partial refund may be granted, deducting applicable service usage charges for the leads provided or services consumed. Additionally, HSPL may deduct platform usage fees or other applicable charges that cover the cost of services already rendered.
- Bank and Payment Delays: HSPL is not responsible for any delays caused by the User's bank, payment gateway, or financial institution in crediting the refund. Users should allow additional time as per their bank's processing timelines.
- Right to Modify Terms: HSPL reserves the absolute right to amend, revise, or modify this Refund Policy at any time, without prior notice, in accordance with applicable laws and business requirements.
Privacy Policy
The Platform's Privacy Policy explains how personal data may be used. The platform respects and ensures adherence to the privacy policy. Users can control the visibility of their information on their profile and choose how they want to be contacted. Any feedback provided by a user is deemed non-confidential.
Terms of Use for Users:
- Users authorizing HexaHome to contact them, even if registered with NDNC/DNC, when expressing interest in a Real Estate Listing.
- Consent for data to be provided to Advertisers/service providers and others for contact purposes.
- Acknowledgment that HexaHome is not responsible for the content of Advertiser/seller’s application form, messages, or documents.
- Consent for processing and analysis of application materials by HexaHome.
- Users are responsible for information posted in public areas, and HexaHome is not responsible for third parties' use of such information.
- Users should use the 'Opt-out' options to control data access.
- Users may sign in using Apple ID/Google login, authorizing access to certain account information.
Terms and Conditions Specific for Dealers/Builders/Banks/Payment Gateways:

- Providing reasonable assistance in case of Data Security Breach.
- Responsibility for complying with individual requests regarding personal data.
- Warranty not to disclose or transfer Personal Data to sub-processors without safeguards.
- Retention or processing of shared personal data for the necessary duration.
Arbitration:
Disputes between users and HSPL will be referred to a sole Arbitrator in Delhi, following the Arbitration & Conciliation Act, 1996.
Severability of Provisions:
The way you use HexaHome is governed by THIS AGREEMENT between you and HSPL. The enforceability of any other provision of the terms and conditions will not be impacted if any part or all of these HexaHome terms and conditions are found to be invalid or inconsistent with any law, rule, order, or regulation of any government, or if a court renders a final decision on the matter.
Waiver:
HSPL's failure to exercise a right or provision doesn't constitute a waiver of its right to enforce it subsequently.
Governing Law:
Indian laws govern all matters related to HexaHome and its terms and conditions.
Jurisdiction:
Exclusive jurisdiction in all matters related to HexaHome and its terms and conditions lies with the courts at New Delhi, India.
HSPL reserves the right to take necessary action, at its sole discretion, upon discovering any improper use of HexaHome or its Services. Users understand that HSPL may report unlawful activities and share relevant information with law enforcement agencies as deemed necessary. HSPL is committed to cooperating with authorities in investigations related to suspected illegal activities on the Internet
All other rights are reserved by HSPL.
Grievances:
Users can report complaints and grievances via the grievance portal.
